PROBATE

Our standard charges for a Grant of Probate vary between a matter where we are instructed to extract the Grant of Probate only or where we are instructed to complete the full Administration of an Estate.

Grant of Probate only

Our fees for this service are fixed at £1,500 plus VAT. These do not include any disbursements which may need to be paid via the Client or Estate. We anticipate a simple Grant of Probate to be obtained within 8 weeks of the commencement of the matter.

We will handle the following for our Clients:

  • Initial Meeting with the Clients to obtain instructions.
  • Contacting all Financial Institutions to ascertain a value of the Estate.
  • Drafting H M Revenue & Customs Form IHT205/Form IHT400 depending on the value of the Estate.
  • Drafting Oath for Executors/Administrators through to sending the application to the District Probate Registry.
  • We will then provide you with the original Grant of Probate for use to close the Administration of the Estate and distribute the funds in accordance to the Will/Intestacy.

Disbursements included in this fee:

  • Probate Application Fee of £155 along with an extra 50p per copy of a Sealed Grant of Probate.
  • £7 Swearing of the Oath – Payable to an Independent Local Solicitor.
  • Approximately £250 for Statutory Advertisements in the Local Newspaper and Law Gazette.

Grant of Probate and full Administration of the Estate

It is difficult to ascertain how long this will take to complete, given the difficulties we may come across with Financial Institutions. As a minimum this process should be completed within 12 – 14 weeks. We charge our Clients £200+VAT per hour along with a recommended Value Element in accordance to the Law Society recommendations.

The exact cost will depend on the individual circumstances of the matter and the total amount of assets and liabilities within the Estate. For example, if there are multiple beneficiaries then there may be more work to complete to ensure all beneficiaries’ interests are protected.

We will handle the following for our Clients:

  • Initial Meeting with the Clients to obtain instructions.
  • Contacting all Financial Institutions to ascertain a value of the Estate.
  • Drafting H M Revenue & Customs Form IHT205/Form IHT400 depending on the value of the Estate.
  • Drafting Oath for Executors/Administrators through to sending the application to the District Probate Registry.
  • We will then provide the original Grant of Probate to all Financial Institutions, complete all closure documentation and collect the funds to our Client Account to distribute.
  • We will make all necessary payments for Liabilities/Tax along with making payments to the Beneficiaries.
  • We shall finalise the Estate by drafting the Estate Accounts and request final clearance from HMRC.

Disbursements included in this fee:

  • Probate Application Fee of £155.00 along with an extra 50p per copy of a Sealed Grant of Probate.
  • £7.00 Swearing of the Oath – Payable to an Independent Local Solicitor.
  • Approximately £250.00 for Statutory Advertisements in the Local Newspaper and Law Gazette.

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

Additional costs

  • If there is no will or the estate consists of any share holdings (stocks and bonds) there is likely to be additional costs that could range significantly depending on the estate and how it is to be dealt with. We can give you a more accurate quote once we have more information.
  • If any additional copies of the grant are required, they will cost 50p (1 per asset usually).
  • Dealing with the sale or transfer of any property in the estate is not included.

How long will this take?

On average, estates that fall within this range are dealt with within 3-4 months. Typically, obtaining the grant of probate takes 8-10 weeks. Collecting assets then follows, which can take between 2-3 weeks. Once this has been done, we can distribute the assets, which normally takes 2-3 weeks.
